These Terms of Service ("Terms") govern your use of eTravelSim, provided by Affinity Business Limited ("eTravelSim", "we", "us", "our"), a company registered in England and Wales (company no. 15194670), registered office at Affinity House, Marshall Terrace, Durham, England, DH1 2HT.
By creating an account, placing an order, or otherwise using our website (etravelsim.co.uk) or web app (app.etravelsim.co.uk), you agree to these Terms. If you don't agree, please don't use the service.
You must be at least 18 years old and able to form a binding contract to use eTravelSim. By using the Service, you confirm this is the case, and that any payment details you provide belong to you or that you're authorised to use them.
You're responsible for keeping your login details secure and for all activity under your account. Tell us straight away at admin@etravelsim.co.uk if you suspect unauthorised access.
A business account admin can invite team members, purchase eSIMs on their behalf, and access usage and billing information relating to eSIMs purchased under the organisation. By inviting a team member, the admin confirms they're authorised to do so and to share relevant usage data with that organisation. Where a business account has payment terms (invoice or credit), those terms are set out separately when credit is approved, and payment remains due even if an individual order is disputed internally within the organisation.
Prices are shown in pounds sterling (GBP) and include UK VAT where applicable. We reserve the right to change prices at any time, but changes won't affect orders you've already paid for. Where a "was" price is shown alongside a discounted price, the discounted price is the amount you'll actually be charged.
Payment is processed securely by Stripe. We don't see or store your full card details. For business accounts, payment may also be made by wallet balance (pre-paid) or, where approved, by invoice on agreed credit terms.
An order is accepted, and a contract formed, once payment has been successfully taken and we've confirmed your order.
eSIMs are delivered digitally and instantly (or, where sent to a third party, by SMS or email install link) once payment is confirmed. It's your responsibility to check the eSIM details and install it correctly using the instructions provided. If you don't receive your eSIM within a reasonable time, contact us at admin@etravelsim.co.uk.
Each bundle has a stated data allowance (or unlimited allowance, subject to fair use and, for some plans, a daily reset) and validity period. Data does not roll over once a bundle expires, and unused data is forfeited at the end of the validity period unless stated otherwise. You can top up an active, compatible eSIM with additional data through your account at any time before it expires.
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers normally have a 14-day right to cancel an order for digital content. However, because an eSIM bundle is digital content that begins performing as soon as it's issued and, in most cases, as soon as it's installed, by completing your purchase and choosing to receive your eSIM immediately, you agree that performance begins straight away and you acknowledge that you lose the right to cancel once your eSIM has been delivered and/or activated. This does not affect your right to a bundle that doesn't work as described.
If a bundle is faulty, was mis-sold, or a payment was taken in error, you remain fully entitled to a refund or replacement under UK consumer law, regardless of the above.
eTravelSim is a reseller: your eSIM connects to third-party mobile networks in each destination, provisioned through our connectivity supplier. Coverage, speed and network availability depend on those third-party networks and local conditions, and we can't guarantee uninterrupted or fault-free service. Where a destination page or bundle description names specific networks, this reflects the networks typically used at the time of writing and may change without notice.
It's your responsibility to confirm your device is eSIM-compatible and network-unlocked before purchasing. Any compatibility checker or device list we provide is offered as guidance only and is not a guarantee. We're not liable for a bundle that can't be used because a device turns out to be incompatible or locked, though our 30-day guarantee above may still apply at our discretion.
You agree not to: use the Service for any unlawful purpose; attempt to resell bundles outside of a business account's intended team use without our agreement; interfere with or attempt to disrupt the Service; or attempt to circumvent any fair use limits on unlimited plans in a way that materially exceeds reasonable personal or business travel use.
We may suspend or terminate your account or an individual eSIM if we reasonably believe these Terms have been breached, if required by law or by our suppliers, or to prevent fraud or harm to the Service or other users. You can close your account at any time by contacting us; this doesn't entitle you to a refund for bundles already delivered, except as set out in section 9.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't lawfully be limited or excluded. Subject to that, our total liability to you arising out of your use of the Service is limited to the amount you paid for the bundle(s) giving rise to the claim, and we're not liable for indirect or consequential loss (such as loss of profits or business opportunity). Nothing here affects your statutory rights as a consumer.
All content, branding and software making up the Service belong to Affinity Business Limited or our licensors. You may not copy, reproduce or reuse it without our permission, other than as reasonably needed to use the Service as intended.
We handle personal data in line with our Privacy Policy, which forms part of these Terms.
We're not liable for delays or failures in the Service caused by events outside our reasonable control, including outages or failures of our payment, hosting or connectivity suppliers.
If something's gone wrong, please contact us first at admin@etravelsim.co.uk so we can try to put it right.
These Terms are governed by the law of England and Wales, and any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales. If you're a consumer living elsewhere in the UK, you may also be entitled to bring proceedings in your local courts.
We may update these Terms from time to time. We'll post the updated version here with a new "last updated" date. Continuing to use the Service after changes take effect means you accept the updated Terms; where changes are significant, we'll try to let registered users know by email.
